Many individuals like to display a flag of their school to show that they are part of the alumni. 


You might have experienced being asked by the homeowner’s association to take down a school flag you have setup in front of your house.


Some groups say that it is not allowed as it violates a number of statutes.

Finding Out the Legal Basis

According to Civil Code section 1353.6, flags, banners, posters and signs can be displayed in front of a residence for personal purposes unless these hinder public health and safety or break any law. 


However, banners and flags should measure only a maximum of 15 square feet, while posters and signs must measure only a maximum of 9 square feet.

If the school flag is only 15 square feet or smaller in size, no group can ask you to take it down since no party is put at risk and no statute is broken.

The kind of flag used will also determine the legal basis. For instance, the United States flag can be displayed because of the protection provided by Civil Code section 1353.5. A California state flag can be displayed but still has to follow the requirements according to Civil Code section 1353.6.

Restrictions and laws still apply to the setting up of for sale or for lease signs on real estate. 
Civil Code section 712 to 713 indicates the proper size and measurements to be used for these. 
The property signs can still be put up as long as the recommended dimensions are followed.
